Terms & Conditions

1) Scope

  • These terms apply to your use of our website and to any quote, work order, or invoice we issue.

  • If a separate signed contract conflicts with these terms, the signed contract controls for that job.

 

2) Quotes & Pricing

 

  • Quotes are estimates, based on info you provide and a visual/site review.

  • Standard pricing: hourly mulching, per-acre packages, haul-off per load, tipping at cost, stump-by-unit.

  • Quotes exclude taxes, tipping/disposal, permit fees, and third-party charges unless stated.

  • We may issue a change order if conditions differ (density, rocks/metal, slope, access, hidden utilities, added scope). Work resumes after you approve the change.

3) Scheduling & Access

 

  • We schedule after your written approval and any deposit.

  • You give safe access for trucks, trailers, and equipment. You clear gates/locks and notify neighbors/HOA if required.

  • Weather, wildfire risk, burn bans, road closures, or site conditions may delay work. We’ll reschedule as soon as practical.

 

4) Utilities, Mark-outs & Site Conditions

 

  • You must request utility locates (811) unless we state in writing that we will. Private lines (septic, irrigation, electric to outbuildings, dog fences, etc.) are your responsibility to identify and mark.

  • We are not responsible for damage to unmarked or mis-marked utilities or private lines.

  • You confirm property lines and setbacks. We don’t provide surveying.

 

5) Debris, Disposal & Environmental

 

  • Mulch is left in place unless haul-off is on the quote.

  • Disposal fees are pass-through plus handling, if applicable.

  • We follow local landfill/green-waste rules. If a site refuses a load due to contamination (metal, soil, stumps over limits), extra handling/tipping applies.

 

6) Stumps, Rocks & Grading Limits

 

  • Stump grinding is priced per stump or per inch. Standard grind depth is to grade to ~6–8”. Deeper grind or root tracing is extra.

  • Rocky or metal-laden ground slows production and increases tooth/chain wear; we may reprice or split the job into phases.

  • Final grades are rough-finish unless fine-grading is listed.

 

7) Safety

 

  • We control the work zone. Keep people, pets, and livestock out of marked areas.

  • We may pause work for safety concerns without penalty.

 

8) Payment Terms

 

  • Unless stated: 50% deposit at acceptance; balance due on completion.

  • Invoices are due on receipt. Late balance may incur 1.5% per month (or the legal maximum).

  • You agree to pay reasonable collection costs, attorney’s fees, and returned-payment fees.

  • We reserve lien rights where allowed by law.

 

9) Cancellations & Rescheduling

 

  • Cancel more than 48 hours before mobilization: deposit refundable minus actual costs (permits, special order items, mobilization prep).

  • Cancel within 48 hours of mobilization or after arrival: mobilization fee and any time/materials to date apply.

  • Weather reschedules are no-penalty.

 

10) Warranties & Disclaimers

  • We warrant work will be performed in a workmanlike manner.

  • Natural regrowth occurs; we do not warrant vegetation will not return. Follow-up maintenance is recommended.

  • We are not responsible for pre-existing conditions (hidden debris, contamination, unstable soils), or damage caused by unmarked utilities or objects in the work area.

11) Limits of Liability

 

  • To the extent allowed by law, our total liability for any claim is limited to the amount you paid for the specific job.

  • We are not liable for indirect or consequential damages (lost use, lost profits, delay).

12) Indemnity

 

  • You agree to indemnify and hold us harmless from claims arising out of: (a) your failure to identify/mark private utilities or hazards; (b) your violation of laws, permits, or HOA rules; or (c) your misuse of the work area.

 

13) Photos, Video & Job Data

  • We may take before/after photos or drone footage for documentation, quality control, and marketing. We won’t publish your address or identifying details without your permission. Tell us in writing if you object before work starts.

14) Insurance & Licenses

  • We carry General Liability, Commercial Auto, Workers’ Comp (for employees), and Inland Marine for equipment. Certificates of Insurance available on request.

  • Any required permits are listed on the quote; unless the quote says otherwise, you secure permits and pay related fees.

 

15) Subcontractors

  • We may use qualified subcontractors. We remain responsible for the work they perform under our scope.

16) Website Use (Terms of Use)

  • Content on our site is for information only; it may change without notice.

  • Do not misuse the site, attempt unauthorized access, or scrape content.

  • Links to third-party sites are provided for convenience; their policies apply.

17) Privacy

  • Our Privacy Policy explains how we handle personal data. By using our site or services, you agree to that policy.

18) Public-Sector Work (if applicable)

  • If you hire us to perform work under a state or federal contract, the agency’s terms, wage requirements, insurance, safety, reporting, and flow-downs control if they conflict with these terms.

  • We comply with applicable NAICS/PSC classifications and set-aside rules where required.

 

19) Disputes & Governing Law

 

  • Governing law: Oklahoma. Venue: state or federal courts in Oklahoma, unless a different venue is required by a public contract.

  • Before filing suit, either party may request good-faith mediation. Each party pays its own costs.

20) Changes to These Terms

  • We may update these terms. The “Effective” date shows the latest version. Changes apply to future work and future website use.

 

21) Acceptance

 

  • You accept these terms by: (a) signing our quote/work order; (b) paying a deposit; or (c) allowing us to mobilize and begin work after receiving the quote.
